1. Agreement to Terms

By engaging LumenApps for web development and digital services, you agree to these Terms of Service. Please read them carefully before proceeding with any project.

2. Services

LumenApps provides web development, design, SEO, and related digital services to businesses across India. Our services include but are not limited to:

• Website design and development
• Search engine optimization (SEO)
• Social media management
• Web hosting and maintenance
• Digital consulting services

3. Project Timeline

Project timelines will be communicated to clients before starting implementation and accepting any payments. Standard delivery timeframes are:

• Simple projects: 48 hours to 2 weeks
• Standard projects: 2-4 weeks
• Complex projects: Timeline discussed on case-by-case basis

Important: If the client does not provide required content, feedback, or resources in a timely manner, the project timeline will be adjusted accordingly. We are not responsible for delays caused by client-side dependencies.

4. Payment Terms

4.1 Payment Structure

Payments are collected in splits:

• Partial payment required before project commencement
• Remaining payment due before final delivery
• Specific payment milestones will be communicated for each project

4.2 Payment Methods

We accept all digital payment methods including UPI, bank transfers, and online payment gateways.

4.3 Hosting Fees

Hosting fees are included in our service packages. We manage hosting through enterprise-grade cloud platforms on your behalf.

5. Refund Policy

No refunds will be provided once the website is live and running.

Partial refunds may be considered only in the following circumstances:

• Project is cancelled before deployment to production
• LumenApps is unable to deliver agreed-upon services
• Refund amount will be calculated based on work completed

Fees for completed work, regardless of project status, are non-refundable.

6. Intellectual Property

6.1 Ownership

LumenApps retains full ownership of all code, designs, and intellectual property created for client projects, even after full payment.

6.2 License to Use

Upon full payment, clients receive a non-exclusive, non-transferable license to use the website as a service for their business operations.

6.3 Restrictions

Clients may not:

• Resell, redistribute, or sublicense the code or design
• Claim ownership of the source code
• Reverse engineer or extract components for other projects
• Transfer the website to another hosting provider without our consent

7. Support and Maintenance

7.1 Free Support Period

All packages include free support for 1-3 months after initial deployment (duration depends on package selected).

7.2 Free Support Includes

• Bug fixes and error corrections
• Minor content updates
• Technical support and troubleshooting
• Performance optimization

7.3 Paid Support

After the free support period, continued support is available at additional cost. Major feature additions and redesigns are billed separately regardless of support status.

8. Hosting and Technical Management

LumenApps manages all hosting and technical infrastructure through third-party cloud services (Vercel, etc.). Clients do not receive direct server access or control panel credentials.

All hosting, security updates, and infrastructure management are handled by LumenApps as part of the service.

9. Client Responsibilities

Clients are responsible for:

• Providing accurate business information and requirements
• Timely provision of content, images, and materials needed for the project
• Providing prompt feedback during development phases
• Making timely payments as per the agreed schedule
• Ensuring they have rights to all content they provide

10. Limitation of Liability

LumenApps provides services "as is" for the agreed scope. We are not liable for:

• Client's business losses or lost revenue
• Third-party service outages or failures
• Data loss due to circumstances beyond our control
• Indirect, incidental, or consequential damages

Our total liability shall not exceed the amount paid by the client for the specific project in question.

11. Confidentiality

Both parties agree to keep confidential information shared during the project confidential. We will not disclose your business information to third parties except as required by law or with your explicit permission.

12. Termination

Either party may terminate the service agreement with written notice. Upon termination:

• Fees for work completed up to termination date are non-refundable
• Client's access to the website may be suspended
• LumenApps retains all intellectual property rights
• Any outstanding payments become immediately due

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms of Service shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Kolkata, West Bengal.
